These Terms of Service (“Terms”) apply to your access to and use of the websites, mobile applications, and physical laundry services—including self-service, wash-and-fold, and pickup/delivery services (collectively, our “Services”)—provided by The Laundry Barn LLC (“The Laundry Barn”, “we”, or “us”).

By accessing or using our Services, you agree to these Terms. If you do not agree to these Terms, including the mandatory arbitration provision in Section 9, do not access or use our Services.

1. Eligibility and Authority

You must be at least 18 years of age to access or use our Services. If you are using the Services on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf and that such person or entity agrees to be responsible to us if you or the other person or entity violates these Terms.

2. Accounts and Communication Preferences

To access certain features of our Services, such as scheduling a "Doorstep Difference" pickup or managing a subscription, you may need to register for an account. You must provide accurate account information and promptly update any changes. You are responsible for maintaining the security of your account credentials.

By creating an account, you consent to receive electronic communications from The Laundry Barn LLC and our service provider, Agent Gab LLC. These communications may include notices about your account or service status (e.g., "Order Received," "Out for Delivery") and are part of your relationship with us. You agree that any notices, agreements, or other communications that we send to you electronically will satisfy any legal communication requirements.

3. SMS Messaging Program (A2P 10DLC Compliance)

We provide SMS notifications for order updates, reminders, and marketing offers via the Agent Gab LLC platform.

• Consent: By providing your phone number and checking the explicit opt-in boxes on our forms, you consent to receive automated text messages.
• Opt-Out: You may cancel the SMS service at any time by texting "STOP".
• Support: For help, text "HELP" or contact [email protected].
• Fees: Standard message and data rates may apply. Mobile carriers are not liable for delayed or undelivered messages.
• Privacy: SMS opt-in consent and phone numbers will not be shared with third parties or affiliates for marketing purposes.

4. Prohibited Conduct

You will not violate any applicable law, contract, intellectual property, or other third-party right. While using our Services, you will not:

• Engage in any harassing, threatening, or predatory conduct.
• Use or attempt to use another user’s account without authorization.
• Use our Services in any manner that could interfere with, disrupt, or inhibit other users from enjoying the facility or digital portal.
• Reverse engineer any aspect of our Services or discover source code.

5. Service-Specific Terms & Liability Limitations

This section limits our liability. Please read it carefully.

• No Liability for Damage: The Laundry Barn LLC is not responsible for any damage to clothing or laundry items that occur during the standard laundering process, including color bleeding, shrinkage, or tearing of weakened fabrics.
• Lost Items: We are not responsible for any claims of lost items once laundry has been picked up or dropped off.
• Pocket Contents: It is the customer's sole responsibility to ensure all pockets are empty. We are not responsible for damage to the garment or the items themselves (e.g., electronics, money, jewelry, pens) caused by objects left in pockets.
• Right to Refuse: We reserve the right to refuse laundry contaminated with hazardous materials or biohazards (human/animal waste, bed bugs) to protect our facility and other customers.

6. Ownership; Limited License

The Services, including the text, graphics, images, and "The Laundry Barn" logo, are owned by The Laundry Barn LLC or our licensors and are protected under both United States and foreign laws. Except as explicitly stated in these Terms, all rights in and to the Services are reserved by us.

7. Indemnification

To the fullest extent permitted by applicable law, you will indemnify, defend, and hold harmless The Laundry Barn LLC and Agent Gab LLC from and against any losses, liabilities, claims, and expenses arising out of or related to (a) your access to or use of the Services; (b) your User Content or Feedback; (c) your violation of these Terms; or (d) your violation, misappropriation, or infringement of any rights of another.

8. Disclaimers

Your use of our Services is at your sole risk. Except as otherwise provided in a writing by us, our Services are provided “as is” and “as available” without warranties of any kind, either express or implied.

9. Dispute Resolution; Binding Arbitration

Please read this section carefully because it requires you to arbitrate certain disputes and claims with The Laundry Barn LLC and limits the manner in which you can seek relief from us.

Any dispute arising out of or related to these Terms or our Services will be resolved through confidential binding arbitration held in Spencer County, Indiana. You and The Laundry Barn LLC waive your rights to a jury trial and to have any dispute resolved in court.

10. Governing Law and Venue

Any dispute arising from these Terms and your use of the Services will be governed by and construed in accordance with the laws of the State of Indiana. Any dispute between the parties that is not subject to arbitration will be resolved in the state or federal courts of Spencer County, Indiana.

11. Termination

We reserve the right, without notice and in our sole discretion, to terminate your right to access or use our Services. We are not responsible for any loss or harm related to your inability to access or use our Services.
